BUYER BEWARE:     Florida Statute: 475.278, states, “It shall be presumed that all licensees are operating as transaction brokers unless a single agent or no brokerage relationship is established, in writing, with a customer.

Agents who operate as “Transaction Brokers” can’t provide Undivided Loyalty.  Here is what the Florida Transaction Broker Notice says in part, Additionally, parties are giving up their rights to the undivided loyalty of the licensee.  This aspect of limited representation allows a license to facilitate a real estate transaction by assisting both the buyer and the seller, but a licensee will not work to represent one party to the detriment of the other party when acting as a transaction broker to both parties.”

You expect your Attorney or CPA to be unconditionally loyal to you and to be working in your best interest at all times.  Imagine your Attorney also representing the other side of a lawsuit you are in or your CPA also acting as an agent of the IRS.  Shouldn’t you expect full undivided loyalty from your real estate agent as well?
